The painting courses produced by Jan-Ove Tuv are administered under sole proprietorship by the name of «Jan-Ove Tuv». They are hosted by the host/company Simplero. The terms under “1)” relate solely to learnkitschpainting.com.

When you sign up for the free painting course version of Learn Kitsch Painting, or buy the full, six-week course Learn Kitsch Painting, that happens through the host/company Simplero.
Terms under “2)” concern purchase, engagement with course content etc concerning the relationship between customer and “Jan-Ove Tuv” as of signing up via Simplero´s system. Please check the terms provided via the Simplero system when signing up.

When visitors leave comments on the site we collect the data shown in the comments form, and also the visitor’s IP address and browser user agent string to help spam detection.

An anonymized string created from your email address (also called a hash) may be provided to the Gravatar service to see if you are using it. The Gravatar service privacy policy is available here: https://automattic.com/privacy/. After approval of your comment, your profile picture is visible to the public in the context of your comment.

Media

If you upload images to the website, you should avoid uploading images with embedded location data (EXIF GPS) included. Visitors to the website can download and extract any location data from images on the website.

Cookies

If you leave a comment on our site you may opt-in to saving your name, email address and website in cookies. These are for your convenience so that you do not have to fill in your details again when you leave another comment. These cookies will last for one year.

Articles on this site may include embedded content (e.g. videos, images, articles, etc.). Embedded content from other websites behaves in the exact same way as if the visitor has visited the other website.

2) Terms for signing up/purchase through Simplero:

Deadline for refund

For courses with a 14 day refund deadline, this deadline is counted from date of purchase (unless other terms are announced). The refund will be sent to the same account the money was transferred from. If you do not let me know before the deadline has expired, the right to a refund is nonexistent and money will not be reimbursed. 

You can also transfer your purchase to a later course round or my other products or services (physical courses, one-on-one conversations, etc.). If there is a discrepancy in price, you will have to pay that amount (or receive a refund of said discrepancy).  

NB: please also read “Cancellation and Postponement”).

Cancellation and Postponement

I reserve the right to cancel or postpone the course as a consequence of causes beyond my control (see “Force majeur”at the bottom). NB: If cancellation occurs on the part of the participant, no refund will be issued after the 14 day refund period as described above. 

If I have to postpone, the participant can choose between a refund or participation at a later point (within one year).

Guarantees

Any guarantees in connection with purchasing one of my products/services are only valid if the preconditions are met and I am notified via e-mail before the guarantee expires. 

All access to the course portal (supplied by Simplero) and connected services will be stopped after a refund.

Payment                  

Payment happens only via Debit/Credit card. I accept Visa and MasterCard through Stripe/Simplero. 

All transactions are sent encrypted via SSL (Secure Sockets Layer) and are 100% safe.

Installments

Installment purchases are binding and shall be paid in full before deadline.

Sales to minors

If you are under the age of 18, you must have parental consent to buy my products.

It is strictly forbidden to copy, distribute, publish or alter material produced by me.

Conditions for the use of course content

You are buying access to the course portal for the duration of the course, including 12 months additional access. The product is only for personal, non-commercial use.

You cannot use the product or material available in the product in a way which violates the rights of Jan-Ove Tuv, or in a way which has not been authorized by Tuv. You cannot alter, copy, reproduce, publish, upload, post in social media, translate, sell, exploit or distribute in any way or medium (e. g. e-mail or other electronic means) any material from the product. Duplication, sharing or uploading of product files to internet sites will be regarded as theft and reported to the police according to what the law allows. 

When you register to a course you will receive a user name and password, giving you access to Simplero (the platform that hosts my online courses). Should you wish to take my online course together with others (partners, etc.), course fee must still be paid for each participant.

Confidentiality

I respect your privacy, and must insist that you respect the privacy of the other course participants. In other words, this is a reciprocal agreement of professional secrecy. I respect your confidential information, ideas and plans. In buying this course you agree in respecting the same rights of other participants and Jan-Ove Tuv.

You are free to discuss your personal results from my courses and assignments. However, all experience and statements from all other participants or Jan-Ove Tuv (verbally or in writing) must be kept strictly confidential.

Safety & Privacy

I use SSL (Secure Socket Layer), which means that all purchases are encrypted, i.e. safe. I guarantee that I will never give out your personal information or e-mail address to third party, except in the case of special reasons (f. ex. requests from police, public prosecutor or similar). 

You have the right to the information I have registered about you. If you feel it is wrong or irrelevant, you may request a correction, or removal from my customer register.

Limitations on responsibility 

I disclaim all economic demands attached to any of my websites, videos, newsletters, course portal (Simplero) or other content. I have done my utmost to secure high quality content. 

In buying my online course you accept that you are fully responsible for your own progress and results. I offer no guarantees of income or results. You alone are responsible for your actions, and your results depend on personal factors, including talent, knowledge, ability, engagement and economic situation (and other factors).

Limitation and responsibility

In buying this product you consent to using my services at your own responsibility, and that you are buying a service of education. 

You exempt the sole proprietorship «Jan-Ove Tuv» of responsibility for any damages that may occur, and of potential demands that should arise in connection with agreements between the parties. You accept all potential risks, foreseeable and unforeseeable.

No public smearing

In case of a dispute between yourself and «Jan-Ove Tuv», you agree that the only arena of solving such a dispute shall be communication between yourself and Tuv. You agree that you will not participate in any conduct or communication with third party, public or private, which may lead to public smearing of Tuv.

This agreement

This agreement cannot be transferred by any of the parties.

Termination

In buying this product, you agree that Tuv can, by personal estimation, end this agreement and limit, suspend or terminate a customer´s participation in the program without a refund should the customer become a disturbance to Tuv or the other course participants. This also applies to violations of conditions.

Force majeur

If Tuv is hindered from teaching due to conditions over whom neither party can have control (such as public restrictions, fire, war, mobilization or unforeseen military drafts of similar extent, requisition, confiscations, currency restrictions, riots and disturbances, shortage of means of transportation, general shortage of goods – as well as shortcomings in or delays of delivery from subcontractors or producers due to circumstances mentioned in this point), Tuv is exempt from all responsibility, except from complaint cases, where Tuv will reimburse the cost of the defective product.
